Terms of Use

1. About these terms

These terms are an agreement between you and Harry Meldon, trading as Backspace (“Backspace”, “we”, “us”), based in the United Kingdom. They apply when you use the Backspace apps and the website at getbackspace.app (together, “the service”). By creating an account or using the service, you agree to them. If you don't agree, please don't use Backspace.

Our Privacy Policy explains how we handle your personal data, and forms part of these terms.

2. Your account

  • You must be at least 13 years old, or the minimum age in your country for agreeing to online services without a parent's consent, whichever is higher.
  • Give accurate information when you sign up, and keep your email address up to date so we can reach you.
  • Keep your password safe. You are responsible for activity on your account. Tell us straight away at [email protected] if you think someone else has access to it.
  • One person per account. Don't create accounts for others without their permission, and don't create accounts automatically.
  • Usernames that impersonate someone, infringe a trademark or break the community rules may be changed or reclaimed.

3. Your content

“Your content” means what you add to Backspace: logs, ratings, reviews, comments, lists, your profile text and the images you upload.

  • You own your content. We don't claim ownership of it.
  • You give us permission to use it to run Backspace. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display and adapt your content (for example resizing an image or showing a review excerpt) so we can operate, promote and improve the service, in line with the visibility settings you choose. This licence ends when you delete the content or your account, except where others have already shared it or we need to keep it for the legal reasons in our Privacy Policy.
  • You are responsible for what you post. Only upload content you have the right to share, and make sure it follows these terms.

4. Community rules

Backspace is for talking about games. When you use it, don't:

  • harass, bully, threaten or intimidate anyone, or encourage others to;
  • post hate speech, or content that attacks people for who they are;
  • post sexually explicit content, graphic violence, or anything that sexualises minors;
  • share other people's personal information without their permission;
  • impersonate another person or organisation;
  • post spam, advertising, scams or misleading links, or manipulate ratings, likes or follows;
  • post content that infringes someone else's copyright, trademark or other rights;
  • post unmarked spoilers in public reviews. Use the spoiler flag;
  • scrape, copy or bulk-download the service or its data, or access it by any means other than our apps and website;
  • try to break, overload or get around the security of the service, or reverse engineer it except where the law allows;
  • use the service for anything illegal.

5. Reporting and moderation

You can report users, reviews, lists and comments from inside the app, and you can block anyone. We review reports and may remove or hide content, reset profile details, or suspend or close accounts that break these terms. We aim to be proportionate and to explain our decision where we can. If you think we've made a mistake, email [email protected] and we'll look again.

We don't check everything before it is posted and aren't responsible for other users' content, but we act on reports.

6. Backspace Pro

Backspace is free. Backspace Pro is an optional paid yearly subscription that adds extra features, such as choosing the cover art for games in your diary, putting game artwork across your profile, colour schemes, alternative app icons and advanced stats. The features included may change over time; we won't remove a core Pro feature during a period you've already paid for.

  • Billing. Pro is sold as a yearly subscription through the Apple App Store or Google Play. The price is shown in the app, in your local currency, before you buy. Payment is taken by Apple or Google when you confirm the purchase.
  • Automatic renewal. Your subscription renews automatically at the end of each period, at the then-current price, unless you cancel at least 24 hours before the period ends. Your account is charged for renewal within the 24 hours before the current period ends.
  • Cancelling. You can cancel any time in your App Store or Google Play subscription settings. Deleting the app or your Backspace account does not cancel the subscription on its own. After cancelling, you keep Pro until the end of the period you've paid for.
  • Free trials and offers. If we offer a free trial or introductory price, the terms are shown before you start. Unless you cancel before the trial ends, the subscription starts at the full price. Any unused part of a trial ends when you buy a subscription.
  • Price changes. If the price changes, Apple or Google will tell you in advance and, where required, ask you to agree.
  • Refunds. Apple and Google handle refunds under their own policies. You can request one through reportaproblem.apple.com or Google Play. This doesn't affect your legal rights as a consumer.
  • If Pro ends. When a subscription expires or is refunded, your account goes back to the free version. Your choices (covers, profile art, colour scheme and icon) are kept, but hidden, and come back if you subscribe again. Nothing you logged, rated or wrote is ever removed because Pro ended.
  • Complimentary Pro and the Founding 100. We may occasionally give Pro free of charge. The first 100 people to create and verify an account while the offer is open (the “Founding 100”) get Pro for life at no cost: it doesn't expire, doesn't need renewing and isn't affected by any subscription. “For life” means for as long as Backspace offers Pro and your account stays open. It ends if you delete your account or we close it for a serious breach of these terms. A founding place that isn't confirmed by verifying your email within 7 days goes back to the pool. Complimentary Pro can't be transferred or exchanged for money.

7. Our content and game data

Backspace™, the Backspace logo, the app design and software belong to us or our licensors. Backspace is a trademark of Harry Meldon. We give you a personal, non-transferable, revocable licence to use the apps for your own non-commercial use, in line with these terms.

Game information, including titles, descriptions, release dates and cover art, is provided by IGDB. Game names, artwork and trademarks belong to their respective owners, and their appearance in Backspace does not mean any endorsement. We can't guarantee game data is always complete or accurate.

8. App Store and Google Play

If you downloaded Backspace from the Apple App Store, you also agree to Apple's Licensed Application End User License Agreement. These terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the app, and isn't responsible for addressing claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

If you downloaded Backspace from Google Play, Google Play's terms of service also apply to your use of the store.

9. Ending your use

You can stop using Backspace and delete your account at any time from Settings → Privacy → Delete account (see Deleting your account).

We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires it, or if we stop offering the service. Where reasonable, we'll give you notice first and, if you ask, a copy of your content. If we close the service entirely, we'll give you at least 30 days' notice.

10. Our liability to you

We provide Backspace with reasonable care and skill, but we can't promise it will always be available, uninterrupted or error-free. We may change, add or remove features.

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't be limited by law. Nothing affects your statutory rights as a consumer.

Otherwise, we are not liable for losses that were not foreseeable, for business losses, or for loss caused by other users' content. To the extent the law allows, our total liability to you for any claim relating to the service is limited to the greater of the amount you paid us for Pro in the 12 months before the claim, or £50.

11. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere in the UK or in the EU, you keep the protection of the mandatory consumer laws of your country and may bring proceedings in your local courts.

12. Changes to these terms

We may update these terms, for example when we add features or the law changes. If a change is significant, we'll tell you in the app or by email at least 30 days before it applies. If you keep using Backspace after that, the new terms apply. If you don't agree, you can delete your account.

If any part of these terms can't be enforced, the rest still applies. If we don't enforce a term straight away, we can still enforce it later.
